California Military and Veterans Code Section 395.10 entitles employees to take up to 10 days off work during a period when their spouse or registered domestic partner is on leave from deployment during a period of military conflict.
Any regular employee who works at least an average of 20 hours per week and whose spouse or domestic partner is a member of the United States Armed Forces, National Guard, or Army Reserve and is on active duty in an area of military conflict.
An eligible employee is allowed to take up to 10 days off from work.
An employee must use all vacation, compensatory time off (CTO) and holiday-in-lieu (HIL) balances before unpaid leave is authorized. Sick leave accruals may not be used.
Within two business days of receiving official notice that the spouse or registered domestic partner will be on leave from deployment, the eligible employee must provide written request, in accordance with department procedures, of their intent to take this leave, and the dates they will be off.
The employee must provide the County with written documentation certifying that the spouse or registered domestic partner will be on leave from deployment during the time of the employee's requested time off.
