9-2203: Property and Business Improvement District Participation Policy

Purpose

The purpose of this Policy is to establish standardized administrative procedures, evaluation criteria, responsibilities, and records management practices governing County participation in Property and Business Improvement District (PBID) petition and ballot proceedings involving County-owned property.

This Policy is intended to:

  • Ensure consistent and legally compliant County participation in PBID matters;
  • Establish clear administrative responsibilities and evaluation procedures;
  • Provide governance and accountability standards for PBID-related actions;
  • Maintain appropriate records and documentation associated with County participation; and
  • Implement the authority delegated pursuant to Sacramento County Board of Supervisors Resolution No. 2026-0193.

Authority

This Policy is adopted under the authority of Sacramento County Board of Supervisors Resolution No. 2026-0193 authorizing the County Executive, or designee, to sign petitions and cast ballots on behalf of the County for County-owned property in connection with PBID formations, renewals, and related actions.

Applicable legal authority includes, but is not limited to:

  • California Streets and Highways Code section 36600 et seq. (Property and Business Improvement District Law of 1994);
  • Applicable Sacramento County administrative policies and procedures; and
  • Applicable County records retention requirements.

The Office of Economic Development shall serve as the lead department responsible for administration and coordination of this Policy.

This Policy applies to all County participation in PBID proceedings involving County-owned property, including:

  • PBID formations;
  • PBID renewals;
  • Annexations;
  • Boundary modifications;
  • Assessment modifications; and
  • Other related PBID proceedings authorized under applicable law.

This Policy applies to:

  • The Office of Economic Development;
  • The County Executive or designee;
  • County departments with property located within PBID boundaries; and
  • County personnel involved in PBID review, coordination, evaluation, approval, recordkeeping, or administration.

This Policy applies to:

  • PBID formations initiated by cities that include unincorporated County territory, which require separate Board of Supervisors approval pursuant to Streets & Highways Code §36620.5 (“(“A city may not form a district within the unincorporated territory of a county without the consent of the board of supervisors.

For purposes of this Policy, the following definitions apply:

Assessment
A levy imposed upon property within a PBID boundary pursuant to applicable law to fund authorized PBID services and activities.

Ballot
An official weighted ballot submitted by an assessed property owner in connection with a PBID formation, renewal, or related proceeding.

County-owned Property
Any real property owned, controlled, managed, or operated by the County of Sacramento that is subject to PBID assessment proceedings.

Designee
An individual formally authorized by the County Executive to act on behalf of the County Executive pursuant to this Policy.

Engineer’s Report
The assessment engineer’s report prepared in connection with PBID proceedings pursuant to applicable law.

Formation
The establishment of a new Property and Business Improvement District pursuant to the Property and Business Improvement District Law of 1994.

Management District Plan
The governing operational and financial plan adopted for a PBID pursuant to applicable law.

PBID
A Property and Business Improvement District established pursuant to the Property and Business Improvement District Law of 1994.

Petition
A petition submitted in support of initiating PBID proceedings pursuant to applicable law.

Position Tracking List
An internal County record maintained by the Office of Economic Development documenting County positions, actions, petitions, ballots, assessments, and related PBID participation history.

Renewal
The continuation or reauthorization of an existing PBID following expiration of its authorized term.

Related Actions
Actions associated with PBID administration or modification, including annexations, boundary adjustments, assessment modifications, renewals, or other proceedings authorized under applicable law.

Property and Business Improvement Districts (PBIDs) are benefit assessment districts formed by property owners to fund enhanced services within defined geographic areas pursuant to the Property and Business Improvement District Law of 1994.

The County may own property within existing or proposed PBID boundaries and, as an assessed property owner, may participate in PBID petition and ballot proceedings in the same manner as other assessed property owners.

County participation in PBID matters shall:

  • Be evaluated on a case-by-case basis;
  • Not create a presumption of County support or opposition for any specific PBID;
  • Be based upon operational, fiscal, governance, legal, and economic development considerations; and
  • Remain subject to the authority delegated by the Board of Supervisors.

Participation in any PBID proceeding shall not obligate the County to support any specific PBID formation, renewal, or related action.

The County Executive, or designee, retains final authority to determine the County’s position and execute petitions and ballots on behalf of the County consistent with applicable Board authorization and County policy.

The Office of Economic Development shall evaluate PBID matters involving County-owned property using factors that may include, but are not limited to:

  • Compliance with applicable statutory requirements;
  • Completeness and sufficiency of formation or renewal materials;
  • Financial impact to the County;
  • Assessment proportionality and reasonableness;
  • Operational impacts to County facilities and services;
  • Demonstrated service value and benefit;
  • Organizational accountability and governance practices;
  • Reporting and filing compliance history;
  • Stakeholder and business community support;
  • Alignment with County economic development and operational priorities;
  • Historical PBID performance, where applicable;
  • Consistency with approved Management District Plans; and
  • Recommendations from impacted County departments or County Counsel.

The County Executive, or designee, may consider additional factors deemed appropriate based upon the circumstances of a specific PBID proceeding.

Office of Economic Development

The Office of Economic Development shall:

  • Serve as the lead department for PBID coordination and administration;
  • Maintain PBID records and project files;
  • Maintain the County-owned property inventory and position tracking list;
  • Review and evaluate PBID materials;
  • Coordinate interdepartmental review;
  • Prepare recommendations;
  • Process and coordinate petitions and ballots;
  • Maintain supporting documentation; and
  • Coordinate with County Counsel and other departments, as necessary.

County Departments

Departments with County-owned property located within existing or proposed PBID boundaries shall:

  • Coordinate with the Office of Economic Development regarding operational and fiscal impacts;
  • Provide requested information necessary for PBID evaluation;
  • Identify operational concerns or service considerations; and
  • Absorb approved PBID assessment costs within existing departmental budgets unless otherwise directed.

County Executive

The County Executive, or designee, is authorized to:

  • Determine the County’s final position on PBID matters;
  • Sign petitions;
  • Cast ballots;
  • Execute related PBID documentation; and
  • Take actions consistent with Board Resolution No. 2026-0193.

All PBID-related records, including but not limited to:

  • Petitions;
  • Ballots;
  • Evaluation materials;
  • Recommendations;
  • Correspondence;
  • Assessment documentation;
  • Position tracking records; and
  • Supporting materials shall be maintained in accordance with applicable County records retention requirements and policies.

Dispute Resolution

Disputes or disagreements regarding County participation, operational impacts, fiscal impacts, or departmental recommendations related to PBID matters shall be elevated to the County Executive, or designee, for final determination.

Review and Revision

This Policy shall be reviewed at least annually by the Office of Economic Development and updated as necessary to maintain consistency with:

  • Applicable law;
  • Board direction;
  • County operational practices; and
  • Administrative requirements.

1. Receipt and Initial Review

Upon receipt of a PBID formation, renewal, or related action request involving County-owned property, the Office of Economic Development shall:

  • Conduct a preliminary review of submitted materials;
  • Verify affected County-owned parcels;
  • Confirm applicable deadlines and procedural requirements; and
  • Establish a PBID project file.

2. Department Coordination

The Office of Economic Development shall coordinate with affected County departments, which may include:

  • Department of Finance;
  • County Counsel;
  • General Services;
  • Airport System;
  • Regional Parks;
  • Department of Transportation; and/or
  • Other affected departments, as appropriate.
  • Affected departments shall provide operational, fiscal, property, or service-related information necessary for evaluation of the PBID matter.

3. Evaluation and Recommendation

The Office of Economic Development shall:

  • Evaluate the PBID matter using the criteria established in this Policy;
  • Document relevant findings and recommendations;
  • Identify anticipated assessment impacts; and
  • Prepare a recommendation for review by the County Executive or designee.

4. Final Determination

The County Executive, or designee, shall:

  • Determine the County’s final position regarding the PBID matter;
  • Authorize execution of petitions and/or ballots, as appropriate; and
  • Ensure actions remain consistent with Board authorization and County policy.

5. Execution and Submission

Authorized petitions, ballots, and related documentation shall be:

  • Executed by the County Executive or designee;
  • Submitted within required statutory deadlines; and
  • Maintained within the official PBID project file.
